LAST WILL AND TESTAMENT
I, ________________, of ________________, being of sound mind and legal age, declare this to be my Last Will and Testament, made on ________________.
1. REVOCATION OF PRIOR WILLS. I revoke all wills and codicils that I have previously made.
2. FAMILY. My family and marital status is as follows: ________________. Any reference in this Will to my children includes children later born to or adopted by me.
3. PAYMENT OF DEBTS AND EXPENSES. I direct my Executor to pay my just debts, funeral expenses, and the expenses of administering my estate out of my estate as soon as practical after my death.
4. SPECIFIC GIFTS. I make the following specific gifts: ________________. If any beneficiary of a specific gift does not survive me, that gift shall pass as part of the residuary estate unless stated otherwise.
5. RESIDUARY ESTATE. I give all the rest, residue, and remainder of my estate, of every kind and wherever located, as follows: ________________.
6. GUARDIAN FOR MINOR CHILDREN. If at my death I have minor children and no other parent is able to serve, I nominate ________________ to serve as guardian of the person and property of my minor children.
7. APPOINTMENT OF EXECUTOR. I nominate ________________ to serve as Executor of this Will. If that person is unable or unwilling to serve, I nominate ________________ to serve as alternate Executor. I request that my Executor be permitted to serve without posting bond.
8. POWERS OF EXECUTOR. I grant my Executor full power to collect assets, pay debts and taxes, sell or distribute property, and take any action reasonably necessary to settle my estate, subject to applicable law and the terms of this Will.
9. NO CONTEST. If any beneficiary contests this Will or any of its provisions without good cause, that beneficiary shall forfeit any gift made to them under this Will, to the extent permitted by law.
10. GOVERNING LAW. This Will is governed by the laws of the State of ________________. If any provision is found unenforceable, the remaining provisions stay in full effect.
11. EXECUTION. I sign this Will as my free and voluntary act, in the presence of the witnesses below, who sign in my presence and in the presence of each other. The witnesses declare that the Testator appears to be of sound mind and under no undue influence.
