LIABILITY WAIVER
This Release and Waiver of Liability (this "Waiver") is made on ________________ by ________________ ("Participant") in favor of ________________ (the "Organization"), in connection with the following activity: ________________, taking place on or around ________________.
1. ASSUMPTION OF RISK. The Participant understands that the activity involves inherent risks, including the risk of physical injury, illness, property damage, and in rare cases death. The Participant knowingly and voluntarily accepts and assumes all such risks, whether known or unknown.
2. RELEASE OF LIABILITY. To the fullest extent permitted by law, the Participant releases and holds harmless the Organization and its owners, employees, and volunteers from any and all claims, demands, or causes of action arising out of the Participant's participation in the activity, including claims based on the ordinary negligence of the Organization.
3. INDEMNIFICATION. The Participant agrees to indemnify and reimburse the Organization for any loss, liability, or cost the Organization incurs as a result of the Participant's participation or the Participant's violation of this Waiver.
4. MEDICAL AUTHORIZATION. If the Participant is injured and cannot consent, the Organization may arrange emergency medical care at the Participant's expense. The Participant's emergency contact is: ________________.
5. MINORS. If the Participant is under the age of 18, the parent or guardian named here, ________________, signs on the Participant's behalf, assumes the risks described above, and agrees to be bound by this Waiver.
6. GOVERNING LAW AND SEVERABILITY. This Waiver is governed by the laws of the State of ________________. If any provision is found unenforceable, the remaining provisions stay in full effect. The Participant has read and understands this Waiver and signs it freely.
