This Lien Waiver and Release is made on ________________ by ________________ (the "Claimant") in connection with labor, services, equipment, or materials furnished to the property located at ________________ (the "Property") for ________________ (the "Customer").
1. TYPE OF WAIVER. This document is a: ________________.
2. PAYMENT AND RELEASE. In consideration of a payment in the amount of $ ________________ (reference: ________________), the Claimant waives and releases any mechanic's lien, stop payment notice, bond right, or similar right the Claimant has on the Property for labor and materials furnished through ________________.
3. CONDITIONAL OR UNCONDITIONAL. If this is a conditional waiver, it becomes effective only when the Claimant has actually received and cleared the payment stated above. If this is an unconditional waiver, it is effective upon signing and the Claimant confirms that the payment has been received.
4. SCOPE AND EXCLUSIONS. This waiver covers only the amount paid and the time period stated. It does not waive rights for work performed or materials supplied after the through date, for amounts not yet paid, or for retainage, extras, and disputed items, unless this is a final unconditional waiver covering all amounts.
5. AUTHORITY AND GOVERNING LAW. The person signing represents that they are authorized to sign on behalf of the Claimant. This waiver is governed by the laws of the State of ________________.
