SEPARATION AGREEMENT

This Separation Agreement (this "Agreement") is made on ________________ between ________________ and ________________ (each a "Party" and together the "Parties"), who were married on ________________.

1. SEPARATION. The Parties have agreed to live separate and apart, effective ________________. Each Party may live as if unmarried and free from interference, authority, or control by the other, as fully as if they had never married.

2. PURPOSE. The Parties wish to settle their rights and duties regarding property, debts, support, and, where applicable, their children. Each Party acknowledges that this Agreement is entered into freely and after the opportunity to seek independent legal advice.

3. CHILDREN OF THE MARRIAGE. The children of the marriage are as follows: ________________. The Parties agree to act in the best interests of any minor children and to support their relationship with both Parties.

11. GOVERNING LAW AND ENTIRE AGREEMENT. This Agreement is governed by the laws of the State of ________________. If any provision is found unenforceable, the remaining provisions stay in full effect. This Agreement is the entire agreement between the Parties on these matters, may be changed only in writing signed by both Parties, and may be presented to a court and incorporated into a later divorce decree.
